Introduction Thank you for using the ESCAPE.AI platform and the products, services, and features we make available to you as part of the platform (collectively, the “Service”). The Service is an AI-powered content platform that enables users to upload, discover, generate, and interact with videos, audio, graphics, photos, text, and other media, including through artificial intelligence and machine learning features.
Our Service The Service allows you to upload, discover, watch, listen to, generate, modify, and share videos, audio, and other content. It provides a forum for people to connect, inform, and inspire others across the globe, and acts as a distribution platform for original content creators large and small. We leverage artificial intelligence (AI) and machine learning (ML) to enhance user experiences, including content recommendation, generation, modification, and analysis. You can find more information about our products and how to use them in our Help Center. The Service is accessible on various devices, including televisions, game consoles, and mobile devices.
Your Service Provider The entity providing the Service is ESCAPE AI, LLC, a company operating under the laws of Delaware, located at 651 North Broad Street, Suite 201, Middletown, DE 19709 (referred to as “ESCAPE.AI,” “we,” “us,” or “our”). References to ESCAPE.AI’s “Affiliates” in these terms mean the other companies within the ESCAPE.AI corporate group (now or in the future). For users in the European Union, our designated EU representative can be contacted at [EU representative contact details].
Applicable Terms Your use of the Service is subject to these terms, the ESCAPE.AI Community Guidelines, the Policy, Safety, and Copyright Policies, the Acceptable Use Policy, and the Privacy Policy (including the U.S. State Privacy Addendum), which may be updated from time to time (together, this “Agreement”). The Privacy Policy, Data Processing Agreement (DPA), Community Guidelines, Copyright Policy, and Help Center are incorporated by reference and available at [insert URLs]. Your Agreement with us also includes the Advertising on ESCAPE.AI Policies if you provide advertising or sponsorships to the Service or incorporate paid promotions in your content. Any other links or references in these terms are for informational use only and are not part of the Agreement. Please read this Agreement carefully and make sure you understand it. If you do not understand the Agreement or do not accept any part of it, you may not use the Service.
Who May Use the Service?
Age Requirements You must be at least 13 years old to use the Service in the United States, or the minimum age required in your jurisdiction (for example, 16 in certain EU countries) if higher. You represent that you meet the applicable age requirement.
Permission by Parent or Guardian If you are under 18 (or the age of majority in your jurisdiction), you represent that you have your parent or guardian’s permission to use the Service. Please have them read this Agreement with you. If you are a parent or legal guardian of a user under the age of 18 (or the age of majority), by allowing your child to use the Service, you are subject to the terms of this Agreement and responsible for your child’s activity on the Service. For U.S. users, we comply with the Children’s Online Privacy Protection Act (COPPA) as outlined in our Privacy Policy. If we learn we have collected personal information from a child in violation of COPPA, we will delete that information and may disable the account; see our Privacy Policy for parental consent and deletion processes.
Businesses If you are using the Service on behalf of a company or organization, you represent that you have authority to act on behalf of that entity, and that such entity accepts this Agreement.
Your Use of the Service
Content on the Service The content on the Service includes videos, audio (for example, music and other sounds), graphics, photos, text (for example, comments and scripts), branding (including trade names, trademarks, service marks, or logos), interactive features, software, metrics, and other materials, whether provided by you, ESCAPE.AI, or a third party (collectively, “Content”). Content is the responsibility of the person or entity that provides it to the Service. ESCAPE.AI is under no obligation to host or serve Content. If you see any Content you believe does not comply with this Agreement, including by violating the Community Guidelines, Acceptable Use Policy, or the law, you can report it to us as described in the “DMCA and Content Removal” section.
ESCAPE.AI Accounts and ESCAPE.AI Channels You can use parts of the Service, such as browsing and searching for Content, without an ESCAPE.AI account. However, you need an ESCAPE.AI account to use certain features, such as bookmarking videos, subscribing to channels, following creators, rating, or commenting. Creating an ESCAPE.AI Creator account provides additional features, such as uploading videos, making comments, or creating playlists (where available). To protect your ESCAPE.AI account, keep your password confidential and do not reuse it on third-party applications.
Your Information Our Privacy Policy explains how we treat your personal data and protect your privacy when you use the Service. We process any audio or audiovisual content uploaded by you to the Service in accordance with the ESCAPE.AI Data Processing Terms (or, for EU users, our Data Processing Agreement compliant with GDPR), except where you uploaded such content for personal purposes or household activities. By using the Service, you consent to the use of your Content and associated data for AI and ML purposes as described in this Agreement, subject to opt-out options for certain sensitive uses. For enterprise or paid private workspaces that you designate as “Private Projects,” ESCAPE.AI will not use Customer Content from those projects to train generalized AI/ML models unless you expressly opt in in writing or via an in-product control.
Permissions and Restrictions You may access and use the Service as made available to you, provided you comply with this Agreement and applicable law. You may view or listen to Content for your personal, non-commercial use. You are not allowed to:
  1. Access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify, or otherwise use any part of the Service or Content except (a) as expressly authorized by the Service, or (b) with prior written permission from ESCAPE.AI and, if applicable, the respective rights holders.
  2. Circumvent, disable, fraudulently engage with, or otherwise interfere with any part of the Service (or attempt to do any of these things), including security-related features or features that prevent or restrict the copying or other use of Content or limit the use of the Service or Content.
  3. Access the Service using any automated means (for example, robots, botnets, or scrapers) except (a) by public search engines in accordance with ESCAPE.AI’s robots.txt file, or (b) with ESCAPE.AI’s prior written permission.
  4. Collect or harvest any information that might identify a person (for example, usernames, faces, or biometric data), unless permitted by that person or allowed under this Agreement.
  5. Use the Service to distribute unsolicited promotional or commercial content or other unwanted or mass solicitations.
  6. Cause or encourage inaccurate measurements of genuine user engagement with the Service, such as by paying for or incentivizing views, likes, dislikes, or subscribers, or otherwise manipulating metrics.
  7. Misuse any reporting, flagging, complaint, dispute, or appeals process, including by making groundless, vexatious, or frivolous submissions.
  8. Run contests on or through the Service that do not comply with ESCAPE.AI’s contest policies and guidelines.
  9. Use the Service to view or listen to Content for anything other than personal, non-commercial use (for example, public screenings or streaming).
  10. Use the Service to sell advertising, sponsorships, or promotions placed on, around, or within the Service or Content, except as allowed in the Advertising on ESCAPE.AI policies (for example, compliant product placements), or sell advertising, sponsorships, or promotions on any page or application where ESCAPE.AI Content is the primary basis for such sales.
Acceptable Use Policy In addition to the restrictions above, you may not use the Service to:
  1. Upload, share, or promote Content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or discriminatory, or that violates any applicable law or the rights of others (for example, copyright, privacy, or publicity rights).
  2. Engage in activities that compromise the security or integrity of the Service, such as hacking, phishing, distributing malware, or conducting unauthorized penetration testing.
  3. Use the Service for high-risk activities, including but not limited to critical infrastructure, life-safety systems, or other uses where failure could cause significant harm.
  4. Process or upload biometric data (for example, facial recognition data, voiceprints) without explicit user consent, except as permitted by the Service’s features and this Agreement.
  5. Scrape, crawl, or otherwise extract data from the Service beyond what is expressly permitted.
  6. Engage in deceptive practices, such as impersonation, fraud, or misrepresentation.
  7. Violate U.S. export control laws or sanctions, including accessing the Service from embargoed countries (for example, Cuba, Iran, North Korea, Syria, or certain regions of Ukraine) or by individuals or entities on U.S. restricted party lists.
Violations of this Acceptable Use Policy may result in Content removal, account suspension, or termination, as described below.
Reservation Using the Service does not give you ownership of or rights to any aspect of the Service, including usernames or Content posted by others or ESCAPE.AI, except as expressly provided in this Agreement.
Develop, Improve, and Update the Service ESCAPE.AI is constantly changing and improving the Service. We may use Content uploaded to the Service for any purpose, including but not limited to training, fine-tuning, or developing AI and ML models, generating new content, conducting research, or improving the Service or our business operations. We may also modify or discontinue the Service or its features to enhance performance, comply with legal requirements, or prevent abuse. These changes may affect all or some users. When the Service includes downloadable software (for example, the ESCAPE.AI mobile application), it may update automatically on your device, subject to your settings. If we make material changes that negatively impact your use, we will provide reasonable advance notice, except in urgent situations (for example, preventing abuse, legal compliance, or security issues).
Your Content and Conduct
Uploading Content If you have an ESCAPE.AI Creator Profile, you may upload Content to the Service to promote your business or artistic enterprise. Content must comply with this Agreement (including the Community Guidelines and the Acceptable Use Policy) and applicable law. For example, Content must not include third-party intellectual property (for example, copyrighted material) unless you have permission or are legally entitled to use it. You are legally responsible for the Content you submit. We may use automated systems to analyze Content for infringement, abuse, spam, malware, or illegal content. By uploading Content, you consent to its use for AI and ML purposes, including training models, generating derivatives, and other uses as determined by ESCAPE.AI, subject to opt-out options for sensitive data.
Rights You Grant You retain ownership of your Content. However, by uploading or providing Content to the Service, you grant certain rights to ESCAPE.AI and other users to operate, improve, and expand our AI-powered platform.
YOU ACKNOWLEDGE AND AGREE THAT WHILE YOU RETAIN OWNERSHIP OF YOUR UNDERLYING INTELLECTUAL PROPERTY (“IP CREATOR RIGHTS”), YOU HEREBY GRANT ESCAPE.AI A PERPETUAL LICENSE TO USE, MODIFY, AND COMMERCIALIZE SUCH CONTENT IN ACCORDANCE WITH THE TERMS AND CONDITIONS SET OUT HEREIN.
License to ESCAPE.AI By providing Content to the Service, you grant ESCAPE.AI a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, distribute, modify, adapt, prepare derivative works of, display, perform, analyze, store, and otherwise exploit that Content in any manner and for any purpose, including but not limited to:
  1. Operating, promoting, and redistributing part or all of the Service.
  2. Developing, training, fine-tuning, or improving AI and ML models, algorithms, or technologies.
  3. Generating new content, variations, or derivatives using AI tools.
  4. Conducting research, analysis, or experimentation.
  5. Commercializing or monetizing the Content or its derivatives.
  6. Sharing or licensing the Content with Affiliates, partners, or third parties.
  7. Any other uses, without limitation, whether or not related to the service.
  8. Analyzing user video and media content, including audio, visual, and metadata components, to improve, train, or enhance ai models and media processing capabilities.
  9. Performing automated or human-assisted lip synchronization (“lip sync dubbing”) of user content into other languages or formats.
  10. Remixing, editing, or otherwise recombining user content to create new formats or versions, including short-form, highlight, or composite works.
  11. Creating “vertical content” from “horizontal content,” including formatting adaptations for mobile, social, or connected television distribution.
  12. Up-resing or enhancing user content, including converting to 4k or other higher-resolution outputs.
This license is worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable, survives account termination or Content removal, and includes the right to use Content independently of the Service. You waive any moral rights, rights of publicity, or similar rights in the Content to the extent permitted by law. If your Content contains sensitive data (for example, biometric identifiers, health information), you may opt out of certain AI uses via your account settings, though this may limit Service functionality.
License to Other Users You grant each other user of the Service a worldwide, non-exclusive, royalty-free license to access your Content through the Service and to use it (for example, reproduce, distribute, prepare derivative works, display, perform) only as enabled by Service features (for example, playback or embeds). This license does not permit use of your Content outside the Service.
Duration of License The licenses granted are perpetual and irrevocable. ESCAPE.AI may retain and use copies of your Content indefinitely for any purpose, including archival, AI training, or legal compliance, even after you remove it from public display.
Ownership of AI-Generated Content Any content generated, modified, or derived from your Content using AI or ML features of the Service (for example, AI-generated variations, enhancements, or new works) is owned exclusively by ESCAPE.AI. You have no ownership or rights in such AI-generated content, except as granted back through specific Service features.
Monetization and Payouts If the Service enables monetization of your original Content, ESCAPE.AI will remit to you 70% of Net Revenues attributable to that content and retain 30%. “Net Revenues” means gross receipts actually received by ESCAPE.AI that are directly attributable to your monetized content less payment processing, platform, marketplace and app-store fees, refunds and chargebacks, taxes, and third-party costs directly tied to such receipts. Payouts occur monthly within 30 days after month-end, subject to KYC/AML verification, valid tax forms, minimum payout thresholds, and fraud/compliance holds. ESCAPE.AI may offset negative balances and amounts related to suspected fraud or violations. AI-generated derivatives may be monetized by ESCAPE.AI without revenue share unless otherwise stated in a written program.
Connected television (ctv) Revenue Sharing If escape.ai licenses, syndicates, or otherwise distributes a user’s content to a connected television (“ctv”) provider or platform, escape.ai shall share fifty percent (50%) of the net revenue actually received by escape.ai from the pooling of such licensing with participating creators selected by escape.ai, after deduction of all third-party costs, platform fees, transaction expenses, and any taxes or administrative charges incurred by escape.ai in connection with such distribution. escape.ai shall provide a statement of account upon payment, and all such revenue shares shall be remitted in accordance with standard payout procedures.
Removing Your Content You may remove your Content from public display on the Service at any time. However, due to the perpetual license, ESCAPE.AI may continue to use, store, and exploit the Content as permitted herein. You may make a copy of your Content before removal. You must remove your Content if you no longer have the required rights.
Removal of Content by ESCAPE.AI We may remove or take down Content that (1) breaches this Agreement or (2) may cause harm to ESCAPE.AI, our users, or third parties, at our discretion. We will notify you of the reason unless we reasonably believe that doing so would breach the law or a legal enforcement authority’s direction, compromise an investigation or the Service’s integrity, operation, or security, or cause harm. For EU users, removal notices and appeals comply with the Digital Services Act (DSA).

We maintain a repeat-infringer policy and may terminate accounts of users who repeatedly infringe copyrights or other intellectual property rights. Details are in our Copyright Policy. You may also report non-copyright violations via our reporting tools.
Account Suspension and Termination
Terminations by You You may stop using the Service at any time. Follow the instructions in your ESCAPE.AI account to delete your profile and remove your data. Licenses granted to ESCAPE.AI survive termination.
Terminations and Suspensions by ESCAPE.AI ESCAPE.AI may suspend or terminate your account or access to the Service if (a) you materially or repeatedly breach this Agreement, (b) we are required to comply with a legal requirement or court order, or (c) we reasonably believe your conduct creates liability or harm to any user, third party, ESCAPE.AI, or our Affiliates.
Notice for Termination or Suspension We will notify you of the reason for termination or suspension unless we reasonably believe that doing so would violate the law or a legal enforcement authority’s direction, compromise an investigation, compromise the Service’s integrity, operation, or security, or cause harm. EU users may appeal terminations under DSA procedures.
Effect of Account Suspension or Termination If your account is terminated or access is restricted, you may continue using certain aspects of the Service (for example, viewing only) without an account, and this Agreement will continue to apply. If you believe a termination or suspension was in error, you can appeal using our appeal form. Licenses granted to ESCAPE.AI remain in effect.
About Software in the Service
Downloadable Software When the Service includes downloadable software (for example, the ESCAPE.AI mobile application), unless governed by additional terms, ESCAPE.AI grants you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software as part of the Service. This license is solely to enable you to use and enjoy the Service as permitted by this Agreement. You may not copy, modify, distribute, sell, lease, reverse-engineer, or extract the source code of the software, unless permitted by law or with ESCAPE.AI’s written permission.
Open Source Some software used in the Service may be offered under an open source license, which we make available to you. Provisions in such licenses may override parts of this Agreement, so please review them.
Beta Features From time to time, we may offer access to beta features or services. These are provided “as is” with no warranties, and we may modify or discontinue them at any time. Your use of beta features is at your own risk.
Other Legal Terms
Warranty Disclaimer OTHER THAN AS EXPRESSLY STATED IN THIS AGREEMENT OR AS REQUIRED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND ESCAPE.AI DOES NOT MAKE ANY SPECIFIC COMMITMENTS OR WARRANTIES ABOUT THE SERVICE. FOR EXAMPLE, WE DO NOT MAKE ANY WARRANTIES ABOUT (A) THE CONTENT PROVIDED THROUGH THE SERVICE, (B) THE SPECIFIC FEATURES OF THE SERVICE, OR ITS ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS, (C) THAT ANY CONTENT YOU SUBMIT WILL BE ACCESSIBLE ON THE SERVICE, OR (D) THE ACCURACY, QUALITY, OR NON-INFRINGEMENT OF AI-GENERATED CONTENT.
Limitation of Liability EXCEPT AS REQUIRED BY APPLICABLE LAW, ESCAPE.AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE RESPONSIBLE FOR ANY LOSS OF PROFITS, REVENUES, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS, LOSS OR CORRUPTION OF DATA, INDIRECT OR CONSEQUENTIAL LOSS, OR PUNITIVE DAMAGES CAUSED BY:
  1. ERRORS, MISTAKES, OR INACCURACIES ON THE SERVICE;
  2. PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICE;
  3. ANY UNAUTHORIZED ACCESS TO OR USE OF THE SERVICE;
  4. ANY INTERRUPTION OR CESSATION OF THE SERVICE;
  5. ANY VIRUSES OR MALICIOUS CODE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY;
  6. ANY CONTENT WHETHER SUBMITTED BY A USER OR ESCAPE.AI, INCLUDING YOUR USE OF CONTENT; AND/OR
  7. THE REMOVAL OR UNAVAILABILITY OF ANY CONTENT.
THIS PROVISION APPLIES TO ANY CLAIM, REGARDLESS OF WHETHER THE CLAIM ASSERTED IS BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. ESCAPE.AI AND ITS AFFILIATES’ TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF REVENUE THAT ESCAPE.AI HAS PAID TO YOU FROM YOUR USE OF THE SERVICE IN THE 12 MONTHS BEFORE THE DATE OF YOUR NOTICE, IN WRITING TO ESCAPE.AI, OF THE CLAIM, AND (B) USD $500.
Indemnity To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ESCAPE.AI, its Affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from (i) your use of and access to the Service, (ii) your violation of any term of this Agreement, (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right, (iv) any claim that your Content caused damage to a third party, or (v) any use of AI-generated content derived from your Content. This defense and indemnification obligation will survive this Agreement and your use of the Service.
Feedback License Any feedback, suggestions, or ideas you provide to ESCAPE.AI about the Service are non-confidential and may be used by ESCAPE.AI without compensation or restriction. You grant ESCAPE.AI a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such feedback for any purpose.
Dispute Resolution and Arbitration
Arbitration Agreement Any dispute, claim, or controversy arising out of or relating to this Agreement or the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis, not as a class, consolidated, or representative action. You and ESCAPE.AI waive any right to a jury trial or to participate in a class action. The arbitration will be conducted in English, in Middletown, Delaware, unless otherwise agreed. The arbitrator’s award will be final and binding, except for limited rights of appeal under the Federal Arbitration Act.
Exceptions This arbitration agreement does not apply to claims involving intellectual property rights or small claims court actions eligible for such courts.
Costs Each party will bear its own costs.
Class Action Waiver You and ESCAPE.AI agree that disputes will be resolved on an individual basis only, and you waive any right to participate in or bring any class, collective, or representative action against ESCAPE.AI.
Export Controls and Sanctions You may not use the Service if you are located in, or are a national or resident of, any country subject to comprehensive U.S. sanctions (for example, Cuba, Iran, North Korea, Syria, or certain regions of Ukraine) or if you are listed on the U.S. Department of Treasury’s Specially Designated Nationals List or other restricted party lists under U.S. export control laws, including the Export Administration Regulations (EAR).
Assignment ESCAPE.AI may assign this Agreement, in whole or in part, to any Affiliate or third party in connection with a merger, acquisition, or sale of assets, without your consent. You may not assign this Agreement without ESCAPE.AI’s prior written consent.
Force Majeure ESCAPE.AI will not be liable for any failure or delay in performing its obligations under this Agreement due to events beyond its reasonable control, including but not limited to natural disasters, strikes, governmental actions, or technical failures.
Third-Party Links The Service may contain links to third-party websites and online services not owned or controlled by ESCAPE.AI. ESCAPE.AI has no control over and assumes no responsibility for such websites and services. You should review the terms and privacy policies of any third-party websites or services you visit.
Notices Notices to Escape AI must be sent to: Legal Notices, Escape AI, LLC, 651 North Broad Street, Suite 201, Middletown, DE 19709, USA, and by email to [email protected]. Notices to you may be provided via the Service, email to the address associated with your account, or via posting within your account dashboard. Notices by email are deemed given when sent, and notices by courier upon delivery confirmation.
About This Agreement
Changing This Agreement We may change this Agreement to reflect changes to our Service, business practices, legal or regulatory requirements, or to prevent abuse or harm. If we make material changes, we will provide reasonable advance notice and the opportunity to review them, except when launching new products or features or in urgent situations (for example, preventing abuse or complying with legal requirements). If you do not agree to the new terms, you should remove your Content and stop using the Service.
Continuation of This Agreement If your use of the Service ends, the following terms will continue to apply: “Other Legal Terms,” “About This Agreement,” and the licenses granted by you as described under “Duration of License.”
Severance If any term of this Agreement is unenforceable, it will not affect the enforceability of the remaining terms.
No Waiver If you fail to comply with this Agreement and we do not take immediate action, this does not mean we waive any rights to take action in the future.
Interpretation In this Agreement, “include” or “including” means “including but not limited to,” and examples are for illustrative purposes.
Governing Law All claims arising out of or relating to this Agreement or the Service will be governed by Delaware law, except as provided in the “Dispute Resolution and Arbitration” section. Any claims not subject to arbitration will be litigated exclusively in the federal or state courts of Middletown, Delaware, USA. You and ESCAPE.AI consent to personal jurisdiction in those courts.
Limitation on Legal Action YOU AND ESCAPE.AI AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, TO THE MAXIMUM EXTENT PERMITTED BY LAW. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
Ownership of Trained Models You acknowledge and agree that all artificial intelligence models, algorithms, datasets, and other technologies developed, trained, or improved by ESCAPE.AI through use of any Content, data, or interactions with the Service are and will remain the sole property of ESCAPE.AI. No user shall have any ownership, license, or other rights in or to any such models or the outputs they generate.
User Representations and Warranties You represent and warrant that you own or control all rights in and to the Content you upload, that such Content and its use by ESCAPE.AI as permitted herein will not infringe or violate any intellectual property, privacy, publicity, or contractual rights of any person, and that you have obtained all necessary consents and permissions for any individuals or materials appearing in your Content.
Audit Rights ESCAPE.AI reserves the right to audit any Content, view counts, or revenue events associated with monetized Content to verify compliance with this Agreement. If an audit reveals discrepancies or fraudulent activity, ESCAPE.AI may withhold or recover payments and associated costs.
Data Retention Exception Notwithstanding the deletion or termination of your account, ESCAPE.AI may retain copies of your Content and related metadata for backup, legal compliance, audit, or AI model integrity purposes, consistent with applicable law.
AI-Generated Content Disclaimer ESCAPE.AI makes no representation or warranty regarding the accuracy, completeness, or reliability of any content generated, modified, or derived through the use of artificial intelligence or machine learning features. Users are solely responsible for verifying the accuracy of all AI outputs before use or publication.
You further agree to indemnify and hold harmless ESCAPE.AI from any claim or demand arising out of ESCAPE.AI’s use of your Content in developing or deploying AI or ML models, the creation or commercialization of derivative or AI-generated works based on your Content, or any alleged violation of rights of publicity, likeness, or moral rights arising from such uses.
You acknowledge and agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement, and that all disputes shall be resolved exclusively in the State of Delaware, United States of America, regardless of conflict-of-law principles or consumer protections that might otherwise apply.
